Political Impression | Phooka believes in giving bytes to media outside courts

Senior lawyer turned Aam Aadm Party leader, H.S. Phoolka has all these years gained notoriety for positioning himself outside Courts where cases of 1984 riot victims are being heard to gain popularity at the cost of victims. The cases may not have reached any logical conclusion but one can find Phoolka giving bytes to media persons outside courts.

 Phoolka’s modus operandi


It is time Phoolka should tell the Sikh community whether he had pleaded the cases of the victims as a social cause or charged fee indirectly for the same.  In case of Phoolka, the modus operandi has been most ingenuous, to not to charge anything directly but through his juniors. This has been continuing for years together. Only when it dawned on the victims that you and your junior lawyers were unsuccessful in getting even one of the main accused prosecuted that they began pursuing the cases themselves.

DSGMC pursuing cases now

In some cases the Delhi Sikh Gurdwara Management Committee itself pursued the cases. In one such case, the DSGMC had recently pursued the case against Congress leader Jadish Tytler vigorously. The victim Lakhwinder Kaur had appealed against the clean chit given by the Central Bureau of Investigation to Jagdish Tytler. The case involved the burning of the Pulbangash gurdwara. In another case involving Congress leader Sajjan Kumar one of the victims Sheela Kaur, whose case was being fought by the Delhi Sikh Gurdwara Management Committee that had approached the High Court claiming her statement against the Congress leader had been wrongly recorded by a lower court. It is not only confined to two such cases but a number of victims of 1984 were contemplating to move courts on their own in future. The reason is simple that they have lost faith in you, in your junior advocates and in the system.

Phoolka-the publicity monger


While victims approaching the courts directly and pleading through other lawyers, had received some degree of success, the track record of cases pleaded by you and your so called junior lawyers is abysmally zero. However, to give the impression that you are fighting the cases of all the victims of 1984 riots, you invariably position yourself outside the prominent courts hearing all such cases to give sound bytes to television channels and your version to print media. Does your job involve only gaining publicity through various television channels and newspapers using the piling cases as an alibi for this.

Political Impression | Arvind Kejriwal-A Habitual Trouble Shooter

A common refrain in Delhi that one often hears in Metro and Delhi streets is that Aam Aadmi Party and Arvind Kejriwal are best suited for protests, sit-in-dharnas and candle marches and not for governance.

As a citizen journalist, I tried to have a closer look at why Arvind Kejriwal is called a habitual trouble shooter, always picking up issues with others.

From day one, Arvind Kejriwal created an unpleasant situation in Delhi Government by indulging in frequent tussles with the LG and Commissioner of Police, defying their authority bestowed on them by the Constitution.

The common people of Delhi who are apolitical, say that the controversy surrounding the appointment of acting Chief Secretary Shakuntala Gamlin was totally unnecessary. Similarly, the subsequent step of transferring and sealing the office of Principal Secretary (Services), Anindo Majumdar, and appointing Rajinder Kumar in his place without the consent of LG was uncalled for.

Purchase of snooping equipment


Another case of not giving any thought to vital issues was when the Delhi Government was all set to implement the plan for purchasing snooping equipment worth Rs 3.5 crore and to further widen the area of Anti Corruption Branch by pumping in about  Rs 35 crore wherein AAP workers would have been employed to monitor Government officials, including of the Centre and leaders of Opposition parties, through the specially created cell.

Onion/sugar scams


Instead of concentrating on governance to fulfil promises made to common people, the AAP Government continued with daily fights with ACB Chief M.K. Meena, appointed by the LG. It was likely that this appointee was out to expose AAP Government on the issue of onion and sugar scams. The arrest of Delhi’s former Law Minister Jitender Tomar revealed that his LLB and BSc degrees were fake, which was apparently known to Kejriwal before his appointment. Many FIRs have been registered in various police stations against at least half of Aap Ministers in Delhi a dozen AAP MLAs for their involvement in domestic violence and submission of fake degrees, including the latest one against the present and past minister Asim Khan and  Somnath Bharti, who had to go behind the bars.

400 % hike in MLA perks

Appointing its 21 MLAs as Parliamentary Secretaries and recommending enhancement of salaries and perks of MLAs by 400 per cent are just some of the unpopular measures taken by the AAP Government.

Political Impression | Even SC can’t stop Kejriwal from using exchequer money for personal publicity

It was way back in May 2015 that the Hon’ble Supreme Court of India, in a historic judgment held that taxpayers’ money cannot be spent to build “personality cults” of political leaders. 

However, the directives of the apex court are being flouted with impunity under its very nose in Delhi by none other than Delhi Chief Minister, Arvind Kejriwal who has used Radio and Television channels and various other mediums for his self-promotion.  


A whopping Rs 526 crore has been spent by the Aam Aadmi Party Government in Delhi on advertising. Ironically, the Supreme Court had restrained ruling parties from publishing photographs of political leaders or prominent persons in government-funded advertisements. The apex court had said such photos divert attention from the policy of the government, unnecessarily associate an individual with a government project and pave the way for cultivating a “personality cult”.


How Arvind Kejriwal Government spent the funds from public exchequer on CM’s own promotion is shocking as the Supreme Court judgement makes exception only in case of the photos of only three constitutional authorities – Prime Minister, President and Chief Justice of India – can be used in such ads. But for that too, the personal approval of these three authorities need to be got before publication.

Either Aam Aadmi Party is unaware of the Supreme Court judgement or it has feigned ignorance of it. The fact is that the judgment by a bench of justices Ranjan Gogoi and N.V. Ramana came on the basis of a series of recommendations given by its own committee led by noted legal academician N.S. Madhava Menon on introducing checks on government-funded ads. The committee was formed in April 2014 on a PIL filed by NGO Common Cause had argued that ruling party leaders and ministers were taking undue advantage at public expenses.

The way Arvind Kejriwal Government in Delhi is using State Exchequer for self aggrandisement; it appears Aam Aadmi Party can stoop to any level to gain publicity and to perpetuate its rule in Delhi and try to spread its wings in other parts of the country. The kingpin Kejriwal is known to use and exploit all systems, all people and their emotions to reach to the top.

The very purpose seems to be three fold-to use state funds for self promotion, to defy directions of High Constitutional bodies like the Supreme Court of India to prove a point that AAP is above everyone and that all is fair in love and war.
